This is one of the most common questions we hear from patients considering travel to India — and the answer surprises a lot of people.
The short answer: no Under the Medical Termination of Pregnancy Act, as amended in 2021, only the pregnant woman’s own consent is legally required to access abortion care in India, provided she is 18 years of age or older. There is no provision anywhere in Indian law requiring a husband’s, partner’s, or family member’s signature or approval.
Where this misunderstanding comes from In practice, some clinics or individuals have historically requested a husband’s consent as an informal, extra-legal requirement — this is not based in law, and has been a longstanding point of confusion and unnecessary barrier for patients. Legally, it has no basis.
What about unmarried women specifically? In September 2022, India’s Supreme Court ruled decisively on this question in the case of X v. Principal Secretary, Health and Family Welfare Department. The Court held that distinguishing between married and unmarried women in accessing abortion violated the constitutional right to equality and personal liberty. As a result, unmarried women have the same legal right to abortion as married women, including access to the 20–24 week category for qualifying circumstances, such as a change in relationship status or contraceptive failure.
What consent is actually required?
- If you are 18 or older: only your own informed consent.
- If you are a minor, or a person with certain mental health conditions: consent from a guardian is legally required, in addition to relevant medical assessment.
Why this matters if you’re traveling from the UAE If you’re weighing your options and assumed a partner’s or spouse’s approval would be necessary, it’s worth knowing that Indian law places that decision solely with you, as the pregnant woman — a significant legal difference from the framework in the UAE.
